2. Purpose

These Terms and Conditions of Sale define the conditions under which the customer purchases and uses the online course Ceramic Photography Course offered by Ceramic Photo School.

Any order implies acceptance of these Terms and Conditions of Sale in the version applicable at the time of purchase.

3. Description of the course

The Ceramic Photography Course is an online course dedicated to photographing and filming ceramic creations, primarily using a smartphone.

It includes in particular:

  • 4 modules;

  • 30 lessons;

  • 60 exercises;

  • more than 3 hours of video;

  • educational content accessible online;

  • educational updates made to the course at no additional cost.

The details and content of the offer are those presented on the website at the time of the order.

4. Technical conditions of access

The course is accessible online.

The customer must have:

  • an internet connection;

  • a recent internet browser;

  • a computer, tablet or smartphone capable of accessing the website and playing videos;

  • a personal member account on stevedrevet.com.

Any internet connection or equipment costs remain the responsibility of the customer.

5. Price

The applicable price is the price displayed on the website at the time of the order.

As of the date of these Terms and Conditions of Sale, the price of the Ceramic Photography Course is €95, as a one-time payment.

No subscription or recurring payment is associated with this purchase.

Steve Drevet currently benefits from the French VAT exemption regime for small businesses. VAT is therefore not charged under the applicable tax regime.

The seller reserves the right to change prices at any time. Any price change will have no effect on an order that has already been confirmed and paid for.

6. Order and payment

Orders are placed directly through stevedrevet.com.

The customer selects the Ceramic Photography Course, provides the required information, creates or uses an existing member account and proceeds with payment.

The available payment methods are those offered at the time of checkout.

The order is considered final once payment has been confirmed, subject to the provisions relating to the right of withdrawal.

An order confirmation is sent to the customer electronically.

7. Access to the course

After payment has been confirmed and the customer has created or logged into their member account, the customer receives access to the four modules included in the Ceramic Photography Course.

Access is personal and reserved for the customer who made the purchase.

The term “lifetime access” used on the website means access without a subscription and without a predetermined contractual expiry date, for as long as Ceramic Photo School and the technical means required to provide the course remain in operation.

In the event that the service is permanently discontinued, the seller will make reasonable efforts to inform users sufficiently in advance where circumstances allow.

8. Personal account and use of content

Login details are personal.

The customer agrees not to transfer access to third parties, share their account, reproduce or redistribute course content.

Photographs, videos, texts, documents, methods and other educational content are intended solely for the customer’s personal use as part of their learning.

Purchasing the course does not transfer any intellectual property rights relating to this content to the customer.

9. Right of withdrawal

In accordance with the French Consumer Code, consumers generally have a period of 14 days from the conclusion of the contract in which to exercise their right of withdrawal, without having to provide a reason.

As the course is supplied as digital content accessible online and without a physical medium, the customer may wish to obtain immediate access before the end of this 14-day period.

Where the customer requests that performance of the contract begin immediately, before the end of the withdrawal period, the loss of the right of withdrawal may only occur where the legal conditions are met, in particular:

  • where the customer has given prior express consent for the supply of the digital content to begin before the end of the withdrawal period;

  • where the customer has acknowledged that they will lose their right of withdrawal as a result of performance beginning;

  • and where the seller has provided confirmation of this agreement under the conditions required by applicable law.

If these conditions are not met, the consumer retains the rights granted by applicable legislation.

Any withdrawal request may be sent to:

ceramicphotoschool@gmail.com

The consumer may use the withdrawal form set out in the following section or any other clear and unambiguous statement expressing their decision to withdraw.

10. Withdrawal form

The customer may also submit any other clear statement unambiguously expressing their wish to withdraw.

11. Statutory warranties

STATUTORY WARRANTY OF CONFORMITY — DIGITAL CONTENT AND SERVICES

The seller is responsible for the statutory warranty of conformity applicable to the digital content and services supplied as part of the course.

For the implementation of this warranty, the customer may contact:

Steve Drevet
3 Cami Del Vilar
66740 Villelongue-dels-Monts
France

Email: ceramicphotoschool@gmail.com
Telephone: +33 6 22 79 51 40

The statutory warranty of conformity applies to defects in conformity appearing throughout the contractual period during which the course is supplied.

During this period, the consumer is only required to establish the existence of the lack of conformity and does not have to prove the exact date on which the defect appeared.

The seller must provide the updates required to maintain the conformity of the digital content or service throughout the period of supply.

In the event of a lack of conformity, the consumer is entitled to have the digital content or service brought into conformity, free of charge, without unjustified delay and without significant inconvenience.

The consumer may obtain a price reduction or terminate the contract in the cases provided for by law, including where:

  • the seller refuses to bring the content or service into conformity;

  • conformity is delayed without justification;

  • bringing the content or service into conformity results in costs for the consumer;

  • it causes significant inconvenience;

  • or the lack of conformity persists despite an attempt to bring the content or service into conformity.

Where the lack of conformity is sufficiently serious, the consumer may, under the conditions provided for by law, obtain an immediate price reduction or termination of the contract.

Where the lack of conformity is minor and the contract provides for payment of a price, it does not by itself entitle the consumer to terminate the contract.

Any period during which the digital content or service is unavailable for the purpose of being brought into conformity may, where applicable, suspend the remaining warranty period.

These rights arise in particular from Articles L.224-25-1 to L.224-25-31 of the French Consumer Code.

The consumer also benefits from the statutory warranty against hidden defects, under the conditions provided for in Articles 1641 to 1649 of the French Civil Code. This action may be brought within two years from discovery of the defect, under the conditions provided for by law.

These statutory warranties apply independently of any commercial warranty that may be offered.

12. Availability and operation of the service

The seller uses reasonable means to maintain access to the course.

Temporary interruptions may nevertheless occur, in particular due to maintenance, updates or technical incidents beyond the seller’s control.

In the event of an access problem, the customer may contact:

ceramicphotoschool@gmail.com

These provisions do not limit the rights granted to consumers under the statutory warranties applicable to digital content and services.

13. Intellectual property

All content included in the course and on the website, including texts, photographs, videos, illustrations, educational documents, methods and graphic elements, is protected by intellectual property law.

Unless prior written permission has been granted, it is prohibited to reproduce, copy, distribute, resell, make available to a third party or commercially exploit such content, in whole or in part.

Purchasing the course grants the customer only a personal right to access and use the content as part of their learning.

14. Personal data

Personal data required to manage orders, member accounts and access to the course is processed in accordance with applicable legislation.

Detailed information regarding such processing, its purposes, retention periods and users’ rights is provided in the Privacy Policy available in the website footer.

15. Complaints

For any question or complaint concerning an order, payment, access to the service or the course content, the customer may contact:

ceramicphotoschool@gmail.com

The seller will make reasonable efforts to seek an amicable solution with the customer.

16. Consumer mediation

After submitting a written complaint to the seller and where no satisfactory solution has been reached, the consumer may refer the matter free of charge to the consumer mediator appointed by the seller.

Société Médiation Professionnelle — Médiation de la consommation
Alteritae
5 rue Salvaing
12000 Rodez
France

Website: mediateur-consommation-smp.fr

The consumer may refer the matter to the mediator:

  • using the referral form available on the mediator’s website;

  • or by post at the address stated above.

The referral to the mediator must be made in writing and in French.

Recourse to mediation requires a prior attempt to resolve the dispute directly with the seller.

Consumer mediation is free of charge for the consumer.

17. Applicable law and disputes

These Terms and Conditions of Sale are governed by French law.

In the event of a dispute, the parties will first seek an amicable solution.

This amicable process does not deprive the consumer of the right to bring proceedings before the competent courts under applicable law.

Where the consumer resides in another country, they also retain, where applicable, the mandatory protections granted by the law of their country of residence.

18. Changes to these Terms and Conditions of Sale

The seller may amend these Terms and Conditions of Sale, in particular to reflect changes to the offer, the website, technical means or applicable legislation.

The Terms and Conditions of Sale applicable to an order are those accepted by the customer at the time of purchase.
